The European Small Claim Procedure gets even simpler for consumers

Small Claim Procedure

The Small Claims Procedure was introduced in 2007 to allow small claims to be settled in a quick, low-cost and hassle-free way. Thanks to the revised rules entered into force on 14 July 2017, the Small Claims Procedure aims at becoming even simpler, faster and more user friendly.

The European Small Claims Procedure is available to litigants as an alternative to the procedures existing under the laws of the Member States. To start it, an online form must be filled in. Thanks to this system, is not mandatory for the defendant to be represented by a lawyer or another legal professional.

About the new rules:

  • The European Small Claims Procedure was covering claims of up to €2,000. The threshold now rises to €5,000, allowing more consumers and businesses to solve their cross-border problems;
  • No need of leaving home to solve the disputes: the new rules limit physical presence only to the cases when the court cannot make a decision based on written documents;
  • Cutting court fees: the court fees have to be proportionate to the value of the claim.
